These Terms of Service ("Terms") govern your use of the Webbed Studio Consult ("Webbed Studio", "we", "us" or "our") website and the services we provide. By using our website or engaging our services, you agree to these Terms.
Our services
Webbed Studio provides digital services including custom software and web development, managed IT and cloud services, WhatsApp Business API setup, offshore staffing and related products. The specific scope, deliverables and fees for any engagement are set out in a separate written quote or proposal.
Quotes and engagements
We provide fixed-scope quotes before work begins. Any work outside an agreed scope is quoted separately. Engagements, payment terms and timelines are confirmed in writing for each project.
Intellectual property
On full payment, you own the custom source code and deliverables we create specifically for your project, except for any third-party or open-source components, which remain under their own licences. The content, branding and design of this website remain the property of Webbed Studio.
Acceptable use
You agree not to misuse our website or services, including attempting to gain unauthorised access, disrupting the service, or using it for any unlawful purpose.
Third-party services
Some services rely on third-party platforms (for example, Meta's WhatsApp Business API, cloud providers and payment gateways). Your use of those platforms is also subject to their own terms, and we are not responsible for their availability or actions.
Disclaimer
Our website is provided "as is" for general information. While we work hard to keep it accurate and available, we do not warrant that it will be error-free or uninterrupted. Nothing in these Terms limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded.
Limitation of liability
To the extent permitted by law, Webbed Studio is not liable for any indirect or consequential loss arising from your use of our website. Our liability for any engagement is governed by the agreement for that engagement.
Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
